Terms of service

These Terms of Service and Student Code of Conduct (“Terms”) apply to all students who purchase, book or attend a training course provided by Mondae Academy (“Mondae Academy”, “Mondae”, “we”, “us” or “our”).

By purchasing a course through the Mondae Academy website, completing checkout and/or attending a Mondae Academy training course, the student (“you” or “the Student”) confirms that they have read, understood and agree to comply with these Terms and the Academy's applicable policies.

These Terms should be read alongside the Academy's separate Refund & Cancellation Policy, Patch Testing Policy, Safeguarding Policy, First Aid Policy, Infection Control & Hygiene Policy, Equality & Diversity Policy, Social Media Policy, Privacy & Data Protection Policy and any other policies or guidance provided to students.

Where a separate policy contains more detailed requirements for a particular subject, that policy should be followed in addition to these Terms.

1. ABOUT MONDAE ACADEMY

Mondae Academy provides professional lash education and training designed to develop students' technical knowledge, practical skills, product knowledge, styling ability, safety awareness and professional practice.

Our courses are designed to provide structured education and are intended to support students in developing their own professional skills.

Mondae Academy does not guarantee that completion of a course will result in employment, clients, income, business growth or any particular financial outcome.

2. BOOKING & ACCEPTANCE OF TERMS

Courses are purchased through the Mondae Academy website using Shopify checkout.

A course place is confirmed once the required payment or deposit has been successfully received.

By completing a booking, you agree to:

  • provide accurate and complete information;
  • attend the course on the agreed dates;
  • participate fully in the training;
  • comply with these Terms and applicable Academy policies;
  • follow reasonable instructions given by trainers;
  • comply with health, safety and hygiene requirements; and
  • behave professionally and respectfully throughout your time at the Academy.

The person who makes the booking is responsible for ensuring that the information supplied during the booking process is accurate.

Course places are reserved specifically for the named student and may not be transferred to another person without prior written agreement from Mondae Academy.

3. COURSE FEES & PAYMENT

Course prices are displayed on the Mondae Academy website at the time of purchase.

Unless otherwise agreed in writing, course fees must be paid in accordance with the payment arrangements shown at checkout and any outstanding balance must be paid before the course begins.

Mondae Academy reserves the right to decline participation where required course fees have not been paid in accordance with the agreed payment arrangements, subject always to the student's legal rights and our separate Refund & Cancellation Policy.

4. REFUNDS, CANCELLATIONS & RESCHEDULING

All student cancellations, refunds and requests to change course dates are dealt with under Mondae Academy's separate Refund & Cancellation Policy.

The Refund & Cancellation Policy forms part of the terms governing your booking and should be read before purchasing a course.

Nothing in these Terms or the Refund & Cancellation Policy is intended to exclude or restrict any statutory rights that apply to the Student under UK consumer law.

5. COURSE DATES & ATTENDANCE

Students are responsible for ensuring that they are available for all scheduled course dates.

Our courses are structured so that skills and knowledge develop progressively. Full attendance is therefore expected.

Students must arrive on time and be ready to begin training at the stated start time.

Late arrival, early departure or missed sessions may affect the student's ability to complete practical or theoretical requirements.

Mondae Academy cannot guarantee that missed teaching can be repeated or that additional training time will be available.

Where a student is unable to attend, they should contact Mondae Academy as soon as reasonably possible and follow the separate Refund & Cancellation Policy.

6. COURSE PARTICIPATION & REQUIREMENTS

Students are expected to participate fully in all relevant aspects of their course.

Depending on the course, this may include:

  • theory;
  • demonstrations;
  • practical training;
  • supervised treatments;
  • mapping and styling exercises;
  • worksheets;
  • quizzes or assessments;
  • case studies;
  • independent practice; and
  • other course-specific requirements.

Students should ask questions whenever they are unsure about a technique, procedure or piece of information.

Students must not knowingly perform a technique or treatment that they have not been trained or authorised to perform as part of their course.

Trainers have the right to stop a treatment or practical activity where they believe it may be unsafe or inappropriate.

7. COURSE CONTENT & CHANGES

Mondae Academy aims to provide the course content described at the time of booking.

We reserve the right to make reasonable changes to course content, teaching methods, trainers, dates or venues where necessary, including where required for health and safety, operational reasons or circumstances outside our reasonable control.

Where Mondae Academy cancels a course, the arrangements set out in the relevant cancellation/refund information will apply.

Any changes will be communicated to students as soon as reasonably practicable.

8. STUDENT ELIGIBILITY & FITNESS TO PARTICIPATE

Students must provide accurate information relevant to their ability to participate safely in practical training.

Before or during training, Mondae Academy may request information reasonably necessary to assess whether practical participation can be carried out safely.

Students must inform the Academy of any relevant medical condition, allergy, sensitivity, injury, physical limitation or other circumstance that may affect their ability to participate safely.

Providing this information does not automatically prevent a student from attending. Where appropriate, Mondae Academy will consider whether reasonable adjustments or alternative arrangements can be made.

The Academy reserves the right to pause or adapt practical training where there is a reasonable health or safety concern.

9. EQUALITY, DIVERSITY & INCLUSION

Mondae Academy is committed to providing a professional, respectful and inclusive learning environment.

Students, trainers, models and visitors are expected to treat one another fairly and respectfully regardless of characteristics protected by law or any other personal difference.

Mondae Academy does not tolerate discrimination, harassment, bullying or victimisation.

Students must not behave in a way that deliberately intimidates, humiliates, excludes or discriminates against another person.

Where a student has a disability or other specific need, Mondae Academy will consider reasonable adjustments where reasonably practicable.

Students are encouraged to communicate any relevant accessibility requirements as early as possible so that appropriate arrangements can be considered.

10. SAFEGUARDING

Mondae Academy is committed to safeguarding the safety and wellbeing of students, models, trainers and visitors.

Students must maintain appropriate professional boundaries at all times.

Any concern relating to the safety or wellbeing of another person should be reported to the Academy as soon as possible.

Concerns may include suspected abuse, neglect, exploitation, harassment, inappropriate behaviour or any situation where an individual may be at risk of harm.

Concerns will be treated seriously and handled in accordance with the Academy's Safeguarding Policy and applicable safeguarding procedures.

Where necessary, information may be shared with appropriate authorities where this is required to protect an individual from harm or to comply with legal obligations.

Under-18s

Students and models under the age of 18 must have appropriate parental or guardian consent before participating in practical training or treatments.

Mondae Academy will not accept students or models under the age of 16 for practical lash treatments.

The Academy may request proof of age or parental/guardian consent where appropriate.

11. PATCH TESTING

Patch testing is a mandatory requirement for live models participating in practical lash training or receiving eyelash extension treatments where the relevant products require patch testing.

Students are responsible for ensuring that their models have been correctly patch tested in accordance with the Academy's Patch Testing Policy before the relevant training session.

A model must not receive the relevant treatment if the required patch test has not been completed or if the result is considered unsuitable.

If a reaction occurs during a patch test, the model must not proceed with the treatment and should be advised to seek appropriate medical advice.

Patch-test results must be recorded as required by the Academy.

Failure to arrange an appropriate model or required patch test does not automatically entitle a student to additional training time.

The full requirements are set out in the Academy's separate Patch Testing Policy.

12. MODELS

Where a course requires a live model, students are responsible for arranging a suitable model unless otherwise agreed with Mondae Academy.

Students must ensure that their model meets all requirements communicated by the Academy.

Students must complete the appropriate consultation and follow all required safety procedures before commencing treatment.

Mondae Academy may refuse to allow a model to participate where there is a reasonable health, safety, suitability or safeguarding concern.

Students must not pressure a model to receive a treatment where the model does not wish to proceed.

13. HEALTH, SAFETY & FIRST AID

The safety of students, trainers, models and visitors is a priority.

Students must follow all reasonable health and safety instructions given by Mondae Academy.

Students must comply with the Academy's:

  • Health & Safety requirements;
  • First Aid procedures;
  • Patch Testing Policy;
  • Infection Control & Hygiene Policy; and
  • any additional safety instructions provided during training.

Students must report accidents, injuries, adverse reactions, product exposure or other safety incidents to a trainer immediately.

Where an emergency occurs, students must follow the trainer's instructions and allow appropriate first-aid or emergency procedures to take place.

14. INFECTION CONTROL & HYGIENE

Students must maintain appropriate hygiene standards throughout practical training.

This includes, where applicable:

  • washing hands before and after practical work;
  • maintaining a clean working area;
  • using equipment safely;
  • cleaning and disinfecting equipment and work surfaces;
  • disposing of single-use items appropriately;
  • following product and manufacturer instructions;
  • following COSHH requirements where applicable; and
  • following the Academy's Infection Control & Hygiene Policy.

Students must not knowingly continue a treatment where they believe there is a health, hygiene or infection-control risk.

15. EQUIPMENT, PRODUCTS & TRAINING PREMISES

Students must use Academy equipment, tools and products responsibly and only for their intended purpose.

Students must follow instructions regarding the safe use, storage, cleaning and disposal of equipment and products.

Deliberate or negligent damage to Academy property may result in the student being held responsible for the damage, subject to applicable law.

Students must leave their workspace clean and organised after practical activities.

16. CERTIFICATION

Certification is awarded based on the requirements of the relevant course.

Depending on the course, certification may require:

  • satisfactory attendance;
  • participation;
  • completion of practical training;
  • completion of theoretical work;
  • successful completion of assessments;
  • completion of case studies; and/or
  • completion of any other mandatory course requirements.

Completion of attendance alone does not automatically guarantee certification where required standards or course requirements have not been met.

Mondae Academy may withhold certification until outstanding requirements have been completed satisfactorily.

A certificate confirms completion of the relevant Mondae Academy course. It does not guarantee employment, insurance, local authority registration, clients, income or business success.

Students are responsible for checking any additional requirements that apply to their own professional practice.

17. ACCREDITATION

Where a course is described as accredited, the relevant accreditation information will be provided with the course details.

Accreditation does not automatically guarantee that a particular insurer, local authority, premises provider or other organisation will accept the qualification.

Students should independently confirm any requirements applicable to their intended professional practice.

18. TRAINING MATERIALS & INTELLECTUAL PROPERTY

All Mondae Academy training materials remain the intellectual property of Mondae Academy unless otherwise stated.

This includes, but is not limited to:

  • manuals;
  • worksheets;
  • presentations;
  • demonstrations;
  • videos;
  • photographs;
  • written content;
  • course structures;
  • mapping resources;
  • exercises; and
  • other educational materials provided by the Academy.

Students may use the knowledge and skills gained through their training in their own professional work.

Students must not, without written permission from Mondae Academy:

  • copy Academy training materials;
  • reproduce manuals or worksheets;
  • distribute or sell course materials;
  • share course materials with non-students;
  • upload Academy materials publicly;
  • reproduce Academy demonstrations or teaching content;
  • use substantial parts of Academy materials to create their own training course; or
  • present Mondae Academy's educational materials as their own.

19. PHOTOGRAPHY & RECORDING

Students may photograph their own work for personal or professional development where this does not interfere with training.

Students must obtain permission before photographing or recording another student, model, trainer or member of staff.

Students must not record, reproduce or distribute full teaching sessions, demonstrations, presentations or course materials without written permission from Mondae Academy.

Students must respect the privacy and wishes of models and other students at all times.

20. SOCIAL MEDIA

Students are expected to use social media responsibly and professionally.

Content posted online should not:

  • contain discriminatory, abusive or offensive material relating to the Academy or individuals connected with it;
  • breach another person's privacy or confidentiality;
  • make false or misleading claims about Mondae Academy, its courses or qualifications;
  • misrepresent the training received;
  • disclose confidential course information;
  • publish photographs or videos of students, models or trainers without appropriate permission; or
  • deliberately damage the Academy's reputation.

Students must not engage in online disputes or arguments on behalf of Mondae Academy.

Any concerns should be raised directly with the Academy rather than through public social media disputes.

The Academy's separate Social Media Policy applies in addition to these Terms.

21. PROFESSIONAL CONDUCT

Students must maintain a professional and respectful attitude towards:

  • trainers;
  • Academy staff;
  • fellow students;
  • live models;
  • visitors; and
  • any other person attending or working within the Academy environment.

Harassment, bullying, threatening behaviour, abusive language, intimidation, discrimination, disruptive behaviour or disrespectful conduct will not be tolerated.

Students must respect professional boundaries at all times.

22. UNACCEPTABLE BEHAVIOUR

The following behaviour may constitute a breach of these Terms:

  • bullying or harassment;
  • threatening, aggressive or abusive behaviour;
  • discriminatory or hateful behaviour;
  • sexual harassment or inappropriate sexual behaviour;
  • deliberate damage to property;
  • theft;
  • persistent disruption of training;
  • deliberately ignoring reasonable health and safety instructions;
  • attending training under the influence of alcohol or recreational drugs;
  • unauthorised recording or distribution of Academy materials;
  • serious or repeated breaches of confidentiality;
  • unsafe treatment practices; or
  • any behaviour that places another person at unreasonable risk.

23. BREACH OF TERMS & REMOVAL FROM TRAINING

Where a student breaches these Terms or an Academy policy, Mondae Academy may take reasonable action depending on the circumstances.

This may include:

  • discussing the concern with the student;
  • giving a verbal or written warning;
  • requiring the student to stop a particular activity;
  • restricting participation in practical training;
  • requiring the student to leave the training environment;
  • withholding certification until outstanding requirements or concerns have been addressed; or
  • ending the student's participation in the course in serious circumstances.

Where appropriate, the student may be given an opportunity to explain the circumstances before action is taken.

Immediate removal may be necessary where behaviour presents a serious safety, safeguarding or wellbeing concern.

Any consequences relating to payment, refunds or cancellation will be dealt with in accordance with applicable law and the separate Refund & Cancellation Policy.

24. PERSONAL BELONGINGS

Students are responsible for their own personal belongings while attending Mondae Academy.

The Academy cannot accept responsibility for loss, theft or damage to personal belongings except where liability cannot lawfully be excluded.

25. PRIVACY & PERSONAL DATA

Mondae Academy collects and processes personal information where necessary to administer courses, communicate with students, maintain appropriate health and safety records, manage certification and meet legal obligations.

This may include information such as:

  • name and contact details;
  • emergency contact information;
  • course attendance and progress;
  • relevant health information;
  • patch-test records;
  • consent records; and
  • other information reasonably required for the safe administration of training.

Personal data will be handled in accordance with the Academy's Privacy & Data Protection Policy.

Students have rights in relation to their personal data as set out in applicable data protection law and the Academy's Privacy Policy.

26. CONFIDENTIALITY

Students must respect confidential information relating to other students, models, trainers and the Academy.

Students must not disclose or publish personal information, consultation information, medical information, contact details or other confidential information belonging to another individual.

Confidential information obtained during training must not be used in a way that could reasonably cause harm, embarrassment or disadvantage to another person.

27. COMPLAINTS & CONCERNS

Mondae Academy wants students to feel able to raise concerns about their training or their experience at the Academy.

Students should raise concerns as soon as reasonably possible so that the Academy has an opportunity to investigate and respond appropriately.

Complaints relating to discrimination, safeguarding, training, conduct, health and safety or other Academy matters will be dealt with under the relevant Academy procedure where one applies.

Nothing in this section prevents a student from exercising any statutory rights available to them.

28. REASONABLE ADJUSTMENTS

Mondae Academy will consider reasonable adjustments where a student or model has a disability or other specific requirement.

Students should communicate relevant requirements as early as possible, ideally before the course begins, so that the Academy can consider what reasonable arrangements may be possible.

Adjustments will be considered on an individual basis and must not compromise the health, safety or wellbeing of the student, model, trainer or other individuals.

29. PHOTOGRAPHY & MARKETING CONSENT

Mondae Academy may ask students separately for permission to use photographs or video of them or their work for Academy marketing.

Marketing consent will be separate from agreement to these Terms.

Students are not required to provide marketing consent in order to attend a course.

Where consent is provided, it may be withdrawn in accordance with the relevant consent arrangements and applicable law.

30. COURSE SUPPORT

Mondae Academy aims to provide a supportive learning environment throughout training.

Students are encouraged to ask questions and seek clarification whenever necessary.

Where post-course support is included with a particular course, the nature and duration of that support will be communicated as part of the course information.

Unless expressly stated otherwise, included support does not constitute unlimited one-to-one tuition.

31. STUDENT RESPONSIBILITY AFTER TRAINING

Students are responsible for continuing to develop their skills and professional knowledge after completing their training.

Students must ensure that their own working practices comply with applicable requirements, including where relevant:

  • insurance requirements;
  • local authority requirements;
  • premises requirements;
  • health and safety requirements;
  • product manufacturer's instructions;
  • professional standards; and
  • any other legal or professional requirements applicable to their circumstances.

Mondae Academy does not accept responsibility for a student's independent practice after completion of training where that practice is outside the Academy's control.

32. LIMITATION OF LIABILITY

Mondae Academy will provide its training services with reasonable care and skill.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Students remain responsible for their own actions and decisions during and after training.

33. EVENTS OUTSIDE OUR CONTROL

Mondae Academy will not be responsible for delays or inability to provide training caused by circumstances outside our reasonable control, such as serious illness, emergency, severe weather, disruption to essential services, venue issues, government action or other circumstances that could not reasonably have been prevented.

Where such circumstances affect a course, Mondae Academy will communicate with affected students and make reasonable efforts to provide an alternative arrangement where appropriate.

34. CHANGES TO THESE TERMS

Mondae Academy may update these Terms from time to time to reflect changes to its services, policies, procedures or legal requirements.

The Terms applicable to a student's booking will generally be those in force when the booking was made, unless a change is required by law or is otherwise applicable to an existing booking.

The current version will be made available through the Mondae Academy website.

35. SEVERABILITY

If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be treated as removed or amended to the minimum extent necessary, and the remaining provisions will continue to apply.

36. GOVERNING LAW

These Terms are governed by the laws of England and Wales.

Where applicable, students who are consumers will retain any rights and protections provided by mandatory UK consumer legislation.

  • agree to respect the Academy's intellectual property and confidential information;
  • agree to use social media responsibly;
